Deficiency in Corporate Manslaughter Law Highlighted


As was pointed out by the recent Sentencing Guidelines Council (SGC) roundtable, a minimum fine of £500k is imposed under the Corporate Manslaughter and Corporate Homicide Act 2007 (CMCHA) currently. Legal firm Thompsons Solicitors stated that de-linking of the fine and the income of the firms is a major deficiency under this system as it fails to prevent the negligent acts of the companies.

Mick Antoniw of Thompsons Solicitors said that the system of imposing at least £500,000 as fine is problematic. It does not have much effect on the big companies, as this fine is quite less for these companies who continue to be indifferent towards the health and safety of their employees.

On the other hand, even a minimum fine will lead to the closure of small firms. These firms will ignore the fine and keep on carrying out their activities without taking care of the health and safety of their employees. Just some 5-10 years back, two firms had been fined when their employees died at Avonmouth Bridge.

Another system has been proposed in the recommendations of the workshop stating that 5-25% of the income of the company should be levied as a fine. In addition, Remedial Orders should be used as a medium to ensure compliance with the Act.

The merit of the proposed system is that it can effectively stop violations and punish the violators, although loss of a life cannot be compensated using money. The exact guidelines will be published by the Council after considering the reactions.

BITC Inaugurates its New Musculoskeletal Health Toolkit


The long felt need for providing the employers with a basic toolkit that would give them guidance for promotion of musculoskeletal health in the workplace has finally been addressed by Business in the Community (BITC) that recently inaugurated its ‘Working Joints and Muscles Toolkit’.

The toolkit is meant for employers and has been introduced with aid from companies like Centrica, HSE, Parcelforce, Work Foundation and Birds Eye.

According to data collected by HSE in 2007-2008, musculoskeletal disorders are not only the biggest reason for work-related illnesses but also result in loss of more than 8.8 million working days every year. Your Mortgage in Spain: What Are Your Choices?

When money is tight, many people end up in a situation where they cannot pay their bills, sometimes including their mortgage. This often leads to homeowners defaulting on their mortgage, and defaulting on a mortgage for a primary or secondary residence can have serious repercussions for the homeowner. These consequences vary by state, province, and country, so you must be sure to completely understand them.

Defaulting on a Spanish mortgage, for example, has very specific consequences. In the past, such defaulting used to be very simple. People who were not Spanish citizens but owned a vacation or second home in Spain could default on the mortgage with little or no cost or repercussions. But now Spanish mortgage holders can and do pursue every legal means necessary to collect on their mortgages.

If you find yourself unable to avoid defaulting on your mortgage in Spain, the bank may agree to take the home back. This simple option will save the homeowner a lot of money in court costs and additional interest on the home loan. However, turning the home over to the bank is a process that must be negotiated. The bank is under no obligation to let you out of the mortgage by taking the home back. They will be rather unlikely to take the home back without good reason such as a hardship. Any homeowners that can prove such a hardship to the bank will be even more likely to succeed in negotiating a turnover.

If despite your attempts to negotiate a home turnover, the bank refuses your offer, you must then sell your home. Try to get a final sale price that will cover the remaining amount on your Spanish mortgage or one that will come as close as possible to paying it off, as the bank will still expect the full amount from you in any case. If the shortfall is significant, the bank will be much more likely to pursue you for that amount. They will attempt to collect the remaining amount they are owed in any legal way they can. This means you may face liens on any assets you own, including your primary home and investments..

Defaulting on a Spanish mortgage is an extremely serious situation, so it is essential that the homeowner work as closely as possible with the bank as soon as it is evident that defaulting is going to be unavoidable. Showing a willingness to work with the bank can allow a homeowner to walk away from a Spanish mortgage with as little financial cost as possible and still retain full ownership of all his or her other assets.

Workplace Stress Not Caused by Work Conditions, Says Expert

Work-related stress has become a matter of concern for modern health experts. In a speech to the Royal Society of Medicine, Dr David Wainwright, a lecturer at the University of Bath, put forth his views in a presentation titled, ‘The Limits of the Work Stress Concept’.

Wainwright cited two reasons behind the ’stress epidemic’. According to him, the first is that the present generation of workers is less resilient when confronted with difficult situations at their workplace. The second reason is the basic and inherent flaw in the way the relation between work and mental health is viewed.

Wainwright pointed out that the model is an engineering metaphor, which complicates the very problem that it seeks to answer - as if the workers are machines with a limit to stress and tension, and so will snap just like a machine if the tension is more than the prescribed limit.

Dr Wainwright argued that the steady rise in cases of workplace stress since the mid-1980s could not be simply attributed to deteriorating conditions of work. In his view, work is much simpler now than it used to be earlier, but the habit of ‘medicalising’ every day problems of life has created the stress and a sense of physical and mental insecurity among workers.

However, Dr Neil Shah of the Stress Management Society did not agree with Wainwright’s approach. He said that when change in work is measured, it should not be compared to the work conditions prevailing nearly sixty years back, because much has changed since then. He added that today’s workers have no personal lives of their own.

There may be debate about the actual reason for work stress, but one thing is certain that with 13.5 million workdays lost and 442,000 people affected in 2007-2008, this is a serious issue that cannot be ignored.

Many foreign countries have different regulations regarding the buying and selling of property; this includes Spain where such transactions are regulated. There are two different categories when it comes to the legal process of purchasing Spanish property. First you have the Contrato privado de compraventa, or the preliminary contract, and then you have the Escritura de compravents, or completion contract.


Once the buyer and seller are in agreement on the price then they need to sign a preliminary sales contract. The vendor needs to be able to provide proof that he or she owns the property, and that it is free of any charges, Before this Contrato privado de compraventa will be signed. It is Spanish law to charge all outstanding debts to the actual property, and any remaining debt would be the new owner’s responsibility. Nota Simple tells about outstanding debts.

The completion date, overall price, and property description will all be elaborated in the preliminary sales contract. Expect to pay a deposit that ranges between 5 and 15 percent of the purchase price. This money shall be held in escrow for your benefit. A person would theoretically be able to sign the initial sales contract without a deposit, but it isn’t necessarily a good idea.


The Escritura de compraventa stage, is the second or final contract stage. On the completion date, the balance of the price of purchase and all fees need to be paid by the purchaser. The vendor and the purchaser will then come together to sign the contract, which is equivalent to a deed on the property. The buyer will be provided the public deed of conveyance, also referred to in Spain as the escritura, in the presence of a Notary Public. To make this legal, a copy of the dded must get to a tax office, and then sent to a property registry. In Spain, all deeds of sale must be witnessed by a Notary Public, which is a public official in that country. However, you need to have your own legal counsel to protect your own interests during the transaction. Part of the fees for purchasing include property tax, and legal fees for your Notary Public.

Waste Company Fined after Worker Dies in Workplace Accident

In a recent prosecution of John Stacey and Sons Ltd at Winchester Crown Court, the defendant was accused of breach of section 2(1) of the Health and Safety at Work Act, 1974 and regulation 3(1) of the Management of Health and Safety at Work Regulations, 1999. The defendants pleaded guilty to the charges before Basingstoke Magistrates Court in the last week of June this year.

The incident claiming the life of one Frederick Aubrey took place at the Tadley site of the company in mid-2007. Mr. Aubrey, along with two other workers, was working on a process calling totting, which required him to hand-sort waste at the waste transfer station of the company. A fourth person was assisting them in the process. While they were working, the driver of a skip loader reached the site and asked the fourth person to help him by getting into a shovel loader and assist in tipping over a skip. However, when the driver reversed the direction of the vehicle, he ran over Mr. Aubrey, who succumbed to his injuries within a week of the accident.

The court ordered the company to pay a fine of £60,000 as well as payment of full costs to the tune of £29,061. This resulted in the Health and Safety Executive warning companies to ensure that work sites are completely secure. They have also asked companies to confirm that there are adequate safety measures in place to prevent accidents at the workplace and protect the employees from getting hurt due to vehicles plying at the site, especially in the waste industry, as such dangers are more prominent there.
