Pleural Plaques Compensation Contested by Insurance Giants

A group of insurance companies, comprising of some of the biggest names in the employers’ liability insurance market, have requested that the Damages (Asbestos-related conditions) (Scotland) Act be subjected to judicial review. The Act overrules the 2007 case of Rothwell, and makes pleural plaques a compensatable condition in Scotland.

The insurers who brought the action (Aviva, AXA Insurance, RSA and Zurich) and many other insurers, oppose the Act on a number of grounds. First, they believe that it disregards medical evidence that shows that these plaques have no symptoms and do not lead to asbestos-related conditions like mesothelioma. Second, they argue that it contravenes a principle in UK law under which compensation is payable only when negligent exposure to a threat causes physical injury. Third, they believe that the Act does not fully examine the monetary impact it will have on the tax-paying public as well as firms in Scotland. Last, they also argue that the Act could lead to an increase in insurance costs for the companies, thus harming the fragile economy, as there might be an increase in compensation claims from those who have no symptoms but have been merely exposed to such a risk as the Act describes.

Nick Starling, who is the Director of General Insurance and Health at ABI, justified the move by insurance companies, saying that they had no choice but to move for judicial review, as the Act is based on flawed premise, contravenes basic legal principles, and disregards solid medical evidence.

He clarified that the move was made only because the matter was viewed in a serious light by the insurers. He stated that while the insurers remain willing to compensate those who are genuine sufferers of ill-health as a result of exposure to risky conditions, they are not at all inclined to make payments to those who, while exposed to such dangers, do not suffer from any symptoms, as is the case with pleural plaques.

A Healthy Summertime Snack For Your Kids

Oh, for the lazy days of Summer…. As If!

Nowadays we all rush around trying to balance two jobs, the kids and running the house. Many of us are taking classes on top of that.

The end result is we often just grab whatever is handy to snack on. Chips or sweet snacks like cookies or snack cakes. Not very healthy,eh? Try this instead. Take a few minutes and buy a package of tropical fruit mix at the market along with some wooden skewers. Also buy a package of popcorn chicken bites ( Tyson makes some really good ones).

You have all you need to make a platter of mini kebobs that your children will love.

Just make some up in the morning and place on a platter in the fridge.

They’ll grab ‘em and go.

Here’s the recipe instructions:

Take a skewer and slide two pieces of fruit on

add one piece of pre cooked popcorn chicken

add a slice of banana

you may also put cheese cubes next if you like

now just repeat the process until the skewers are filled up

arrange on a platter and cover with plastic wrap.

Chill and watch them disappear!

This idea works really well as an appetizer also. Simply use long toothpicks instead of skewers and arrange on a bed of rice or lettuce leaves.

Focus on rebuilding a tight image at the online poker table. It is also risky to bluff if you have raised pots, then folded without a showdown. Your opponents will see this as weak play and are more likely to call or bluff a raise back at you. When it comes to bluffing, your last few hands will act as a reference for your opponents. A Harvest Halloween

To take advantage of the last days of autumn, we planned an outdoor Halloween party at our family farm. This gave us an opportunity to bring our friends together in an informal setting before the hectic holiday season.

The kids grew excited as we drove past the harvested fields of rural farmland, the grazing cattle, and brimming roadside stands. The sights and smells of the country awoke their spirits of adventure and they burst from the car as soon as we stopped at the end of the dirt road.

As they explored their surroundings, the adults began to set up. Our party centered on the activity of making scarecrows. We brought out baskets piled high with faded denim coveralls, straw hats, and flannel shirts. The children enthusiastically costumed themselves as well as the scarecrows. They collected autumn grasses and flowers and wove them into straw hats to take home as mementos.

The country setting and the crisp autumn air inspired many activities. Sack races, a tug of war, and a scavenger hunt kept everyone busy throughout the afternoon.

As the day came to a close, our guests enjoyed an Indian summer sunset. We bundled sleepy children into cars and returned home with warm recollections of an afternoon shared with special friends.

The Fathers Day Celebration

Fathers Day only comes once per calendar year, so how will you be honoring the fathers in your life?

Fathers Day is another reason to celebrate another responsible adult in the family. If some of our media sources would have it though, you would think that there are no real fathers around to celebrate on Fathers Day.

Sure there may be many deadbeats who not only have never given a bath, given pep talks to their children or never cooked a meal for their family but there are way, way more good Fathers willing to go that very last mile for their family! But for some very odd reason, it is not publicized like the negatives around fathers.

So what can you do to honor the father in your life who’s willing to run to the store in the middle of the night for a last minute treat? So what can you do to honor the father who figures out how to pay that unexpected bill? So what can you really do to honor the father who makes sure if it’s within his powers to make sure his family has a place to sleep, food to eat and more, honor him and here are some suggestions;

Make every effort possible to have a peaceful family day and for dinner everyone can share with dad why he is so special to them. For example mom, you could lead with “I am glad that the kids have you as a father, we made a great pick.” And assist the smaller children - ask them did you enjoy for example playing with dad? And if they say yes, tell them to tell him.

Fathers Day - Honor Suggestion!
Give him a free day from his life responsibilities and duties by pampering him. Men also need breaks or down time to renew from life! And please don’t pitch a fit if he decides he would like to spend the rest of his last few Fathers Day hours with the guys - hopefully respectful hours. Pamper him on this day.

Honor all the fathers in your life by letting them know how you feel! Remember this old saying, “action speaks louder than words?” Well, nothing beats words and action with meaning from the heart.

Paying The Price

As I sit to write this we are literally only days away from the 20th Winter Olympic Games in Torino, Italy. At a recent speaking engagement someone asked me if I would be competing and I pointed out that I had retired from the sport due to a knee injury I had sustained years ago.

As I later contemplated my answer I realize that that was only part of the truth. In Nagano, Japan I hobbled around on a knee swollen one and half times its size and thought nothing of it. Having competed in three Winter Olympic Games, I knew only too well the enormous price exacted in order to compete at that level, and this time I was simply unwilling to pay it. I was not willing to pay the price of being on the bobsled circuit for months at a time and missing my children growing up. I was not willing to pay the price of not pursuing my new love - a career as a motivational speaker and author. I was not willing to spend the time to hone my skills as a bobsled driver; choosing instead to invest that time learning and developing my skills as an entrepreneur. I was willing to pay the price, but not to get back to the Olympics.

I am reminded of the story of the hostess at a cocktail party. She approached the world famous concert pianist who had just given a wonderful recital and declared that she would give anything to play like him. He looked at her thoughtfully trying to find the kindest way to coach his response. “No you wouldn’t.” He finally said. An embarrassed smile creased her face as she exclaimed, “Yes, I really would!” “No Madame” he asserted, “you would love to play the way I play now, but I promise you, you would not be willing to practice 8 hours a day for the next 20 years to learn to play the way I do.” The silence in the room was deafening. Everyone present knew the pianist was right and that the hostess was only deluding herself.

There is no free lunch. Everything has a price and whether you are competing at the Winter or Summer Olympic Games or, like all of us, in the Olympics of life, you must pay it. You can have anything you want as long as you are willing to pay the price. The cost is exacted in different ways. Sometimes it is in dollars and cents. Perhaps you need to use your life savings and borrow from everyone you know to pursue a business opportunity. Maybe the cost is in time - the hours, weeks and months you need to invest to get that college degree. It could be the sacrifices you need to make. What must you give up to have what you want? The cost could also be in the form of personal growth. Not just in terms of developing your skills and talents, but also in terms of developing your self-esteem and confidence - your ability to elevate your level of thinking.

You don’t get an exciting career, a thriving business or live the life of your dreams without paying the price. The price must be paid in full. It cannot be bartered. Neither can you put it on credit or layaway. Your willingness to pay the price gives you the power to make your dreams come true. A refusal or hesitation to do so ensures that you don’t get to march in the opening ceremonies of life. Instead you are left outside the stadium listening to everyone else enjoying the fruits of their labor and living their dreams.

Chuck Swindoll had this to say about paying the price:

“A piano sits in a room, gathering dust. It is full of the music of the masters, but in order for such strains to flow from it, fingers must strike the keys…trained fingers, representing endless hours of disciplined dedication. You do not have to practice. The piano neither requires it nor demands it. If, however, you want to draw beautiful music from the piano, that discipline is required…

You do not have to pay the price to grow and expand intellectually. The mind neither requires it nor demands it. If, however, you want to experience the joy of discovery and the pleasure of plowing new and fertile soil, effort is required.

Light won’t automatically shine upon you nor will truth silently seep into your head by means of rocking-chair osmosis. It’s up to you. It’s your move.”

If you are unwilling to pay the price for your dreams, you’ll discover as others have, that the cost of regret will be far more taxing. Your willingness to pay it will allow you to discover, as I have, that achieving your goals will be different and more difficult than you imagined.

You will discover strengths and abilities that you didn’t know you had. You will be amazed by how much your horizons have broadened and by how far you can take yourself. In short, if you are willing to pay the price, it will be better and more beautiful than you could ever have imagined.
