Honestly, Are We Really Competing Against Each Other?

When my current lease expires, if I trade-in my Porsche Cayenne for Cadillac, that’ll signify a win for Cadillac and a loss for Porsche, right?

After all, when it comes to earning my business, these manufacturers are playing what’s termed a zero-sum game. If one wins, the other, by definition, loses.

Throughout the economy there are examples of these rivalries, of pitched battles for scarce buyers. And most of us have been schooled to think that we’re incessantly competing, whether we’re students seeking scarce “A’s” in classes, or job seekers, hunting for the best positions.

But the “new economy,” and especially e-commerce, are calling the traditional “me-against-the-world” mindset into question. I, for one, am finding that most of the people and companies against whom I used to think I was competing, simply aren’t significant factors in whether I earn business or fail to earn it.

Here’s what I mean. I consult in the areas of customer service, telemarketing, and selling. I offer keynote speeches, seminars, on-site development programs, and a host of books, audio seminars and video seminars.

My techniques are quite distinctive, and while there are some clients who love all of my stuff, and are proud to have become “Goodman-ized,” most folks don’t rely exclusively upon any single source for their information. They may be hooked on my customer service programs, but happily look elsewhere for their general sales tips.

Am I really competing against the purported “gurus” who supply such sales material, especially because I have what I consider to be some pretty hot books and resources in that area?

Traditional thinking says, emphatically, “Yes!” I shouldn’t be happy with just a portion of my client’s investment in training tools. I should resolve to maximize my profits by getting the entire pie for myself!

After twenty years in consulting, I can tell you this is never going to happen. For one thing, clients crave novelty. They grow bored with a single source, and sooner or later they want to hear other voices.

Rather than fighting this tendency, which is what the “zero-sum” competitor in me used to do, I’m more inclined these days to develop lead-sharing and referral programs with others in the consulting and training world.

In fact, now I’m interested in putting together relationships where I serve as a broker or an agent for people I used to consider to be my direct competitors!

I see it this way. Even if we all had identical strengths and skills and prices, our personalities wouldn’t be perfect matches for every opportunity. Add to this the fact that it is often easier and more credible to sell-in someone else other than oneself, and you have a better recipe for success. Why rely upon the same, narrow range of ingredients all the time?

One final thought. I used to get leads from companies where it was fairly clear to me that I had to really stretch to fit the description of what they were seeking. Instead of twisting myself out of shape, now I see that I should have tried to identify someone else who could have been a better fit.

But in most cases, I’d bury the lead, instead of passing it on, lest my competitors get an advantage. I’m sure that some inquiries simply didn’t buy any services from anyone, as a result. So, my “win-lose” mentality produced a “lose-lose” result. Nobody did any business!

This doesn’t make economic sense, and it’s also poor customer care.

Today, I believe that everyone is better served by changing this viewpoint. We’re not necessarily facing a world of competitors, but rather a world of potential collaborators.

And what we’re really competing against isn’t other people or companies, but against an economic model, based upon scarcity, that simply doesn’t make as much sense as we once thought it did.

DNA Testing has Changed Everything

Since its discovery 20 years ago, the use of DNA for human identity and relationship testing has emerged as a powerful tool in both civil and criminal justice systems. DNA testing can reveal whether two or more individuals are related as well as determining the nature of their relationship. Today, it is possible to identify people by a single hair, as well as obtain information about their gender and ethnic background, and, within the next couple of years, identify their age.

Before the advent of DNA testing, human identity testing was largely carried out through blood typing. DNA analysis has now superseded blood testing and is the most accurate method currently available for human identification.

The possibility that DNA could be used for human identity and relationship testing had been discussed from the time DNA was first revealed as the molecule which makes people unique. Yet, it was not until the discovery of DNA fingerprinting by Prof. Alec Jeffreys (now Sir Alec) of Leicester University in 1984 when the first practical testing system became available. As with conventional fingerprinting, where various loops and whorls are compared between two fingerprints, DNA testing relies on comparing certain DNA features called DNA markers between two individuals. If DNA patterns between the samples are identical, then they are likely to come from the same person. If the profiles are not identical but big similarities are observed, then the samples most probably come from related individuals. The degree of the similarity between DNA profiles is a representation of the degree of relatedness between people.

Currently, DNA testing is routinely used for both criminal and non-criminal applications. However there is a major difference between DNA testing for civil and for criminal cases. For civil cases, DNA testing is predominantly used to determine relationship between individuals while for criminal cases a crime scene stain has to be matched to the suspect.

In non-criminal legal practice, DNA testing is used primarily for immigration and child support cases. In 2004, more than 7,000 DNA tests were conducted for these purposes in the UK. Where no reliable documentary evidence is available, DNA testing can assist in determining varying degrees of relatedness between individuals concerned, as well as individual’s ethnic background.

The first time DNA testing was used for identity purposes was in the landmark immigration case Sarbah vs. Home Office (1985). In this case, DNA testing was used to prove the mother-son relationship between Christiana Sarbah and her son Andrew. Now, the Home Office accepts DNA testing as a virtually unquestionable proof of relatedness. The results will normally (although not invariably) provide conclusive evidence as to whether individuals in question are related as alleged.

UK Child Support Agency extensively uses DNA testing for establishing who the biological parent of the child is for purposes of providing child maintenance and support. Child support is one the main areas of non-criminal DNA testing.

Child adoption is another area where DNA testing is widely applied. Currently, UK adoption agencies adopt children into families which match their ethnic background. Sometimes, it is difficult to determine the ethical background of the child and here DNA testing can help. People of different races and ethnic groups have common facial and other features which are typical for this particular race or group. The same is also true for their genetic characteristics. Various racial and ethnic groups have genetic markers specific to these groups. When analysing these markers, it is possible to tell the proportion of individual’s ancestors who came from specific ethnic groups. It is, however, impossible to pinpoint at what stage the particular ancestors contributed their DNA and also their number. For example, the results of ethnicity DNA testing can show that an individual has 20% of markers specific to northern Europe, 50% to the Middle East, 10% to the Mediterranean and 20% to sub-Saharan Africa. Using this information the family with the closest ethnicity to the child can be chosen.

The Art Of Happy Living

What do you think about happiness? A philosophical approach to life; an intellectual activity or an academical pursuit. No, not at all, nothing of the sort.

Happy living is nothing more than living a normal life free from undue pressures, problems and tensions. The Art of Happy Living is not a complicated kind of art difficult to learn rather a simple art of living well, eating well, thinking well and feeling well. Just tune up your mind to enjoy every moment of life and let the happiness follow you.

Happiness is purely an internal matter. It has nothing to do with your external circumstances. Most people do the fatal mistake of looking outwards for happiness rather than looking inwards. Only fools worry about the circumstances on which they have no control. Why worry if you cannot change the weather, rather enjoy it whether its hot, humid, cold, cloudy, foggy or snowy. Keep your internal weather pleasant all the time. Don’t allow external matters to take your smiles away.

The feeling of happiness is within you. There is something positive within you which keeps you happy and there is something negative within you which keeps you unhappy. That “something” needs to be looked into thoroughly. If you want to live a happy life then get rid of the negative “something” which makes you unhappy. Negative approach always complicates the problems and increases unhappiness.

Happy living is the reward of positive thinking. Remember, only the positive thinking can bring happiness in your life. If you cannot think positively, you cannot live happily. Be your own coach and adviser. Look everything with a positive angle. Find something good even in most critical moments of your life. Make positive thinking the basis of your happy living.

Happiness is all around. Its not far away from you. If you do not want to live happy, its upto you. Its your own choice. Don’t blame others. Don’t blame your fate or external circumstances.

A Maplewood Minnesota attorney won from a advocate in Hartford Connecticut

The Supreme Court then agreed to hear the case and eventually reversed the Second Circuit and reinstated the jurys finding that Knolls policy unlawfully discriminated because of age. Even if the employment action is otherwise prohibited by the ADEA. A lawyer from Waddinxveen won from a lawyer in Fremont California In Meacham Knolls Atomic Power Laboratory was planning to lay off a number of employees. At the trial a jury found Knolls had violated the ADEA because its layoff procedure had a disparate impact based on age. The Supreme Court has previously recognized that the employer has the burden to establish the BFOQ affirmative defense. It has the burden to prove that its decision was based on a reasonable factor other than age. Specifically the jury found that although the plaintiffs did not prove that Knolls intentionally discriminated against them they did prove that Knolls method of deciding who to lay off disproportionately harmed older workers. The Supreme Court ruled that if an employer seeks to rely on that defense. The BFOQ defense states that it is not unlawful for an employer to take adverse employment actions otherwise prohibited by the ADEA where age is a bona fide occupational qualification reasonably necessary to the normal operation of the particular business. In reaching its conclusion that the employer has the burden to prove the reasonable factors other than age defense the Supreme Court looked at another provision of the ADEA the bona fide occupational qualification defense. For example it would not be illegal to consider criteria for a particular role in a movie that has a disparate impact on age if the part calls for someone of a particular age. The company had its supervisors rate their subordinates based on their performance flexibility and critical skills. In other words the ADEA permits employers to discriminate based on age considering age is legitimately necessary under the circumstances. Knolls totaled those scores and gave the employees additional points based on their years of service. As long as the adverse action is based on reasonable factors other than age. The United States Court of Appeals for the Second Circuit initially affirmed the jurys findings but after the United States Supreme Court asked it to reconsider the Second Circuit reversed itself and ruled in favor of Knolls. Thirty of the 59 salaried employees the company laid off were at least 30 years old. It then used those totals to decide who to lay off. In that case Meacham versus Knolls Atomic Power Laboratory the Supreme Court interpreted a provision of the ADEA that permits an employer to take an adverse employment action against an employee. Twenty-eight of those 41 employees sued under the ADEA claiming Knolls illegally fired them because of their age.

Food Sensitivity And Your Health

I’ve recently written about the link between obesity and food sensitivities here in this ezine (see “The Way to Lose Weight Easily and Permanently Without Drugs”)

Isn’t it interesting that individuals with obesity are at higher risk for other illness such high blood pressure, diabetes mellitus, heart disease, arthritis, various forms of cancer etc.

Are these problems due to the obesity itself or are they linked in some other way?

Well it is clear that obesity can have direct effects on other organ systems i.e. placing a greater strain on the heart, joints etc. There is however another connection which is not so direct.

That connection is through what many have termed food sensitivities.

Sensitivity to a food is not dis-similar to sensitivity to a toxin. In other words when you are sensitive to a given food, that food is for all practical purposes toxic to you.

Like any toxin there is a threshold beyond which it begins to become toxic to your body. Beyond this threshold the body has trouble handling and processing the excess intake of that toxin in the normal way and therefore must handle it as if it is a threat to the vitality of the organism.

How does it do that? Well it attempts to store the excess in places like fat, in joints, in muscle tissues, and other tissues that have no use for such toxins. When this happens the normal functioning of these tissues and the organ systems they are associated with begin to break down and malfunction.

The malfunction manifests as the illnesses I mentioned earlier.
How are these illnesses treated commonly? Well with a multitude of chemicals that in themselves are foreign to the normal structure and function of the body.

I will leave it to you to figure out what impact they have on the body’s ability to recover from the excess toxicity it is already carrying.

My personal experience over 6 years ago struggling with Chronic Fatigue Syndrome was that by becoming aware of what toxic food substances I was taking into my body and simply eliminating them my energy levels and my health improved considerably.

Now food sensitivities are not generally something that many physicians ever address with their clients. I know because while I was in medical school I only received one or two classes on nutrition and food sensitivity was never even mentioned.

If you would like to have your own experience with this interesting issue I invite you to do what I did which was as follows:

1. Research food sensitivity testing on the internet under “Electro Dermal Screening” or EDS testing. Please note that you will also find a great deal of negative advertising about EDS from some individuals. Don’t allow yourself to be swayed by words alone; always search out your own experience.

2. Have yourself tested. This will cost you anywhere from $100 to $150 depending on where you live and how many foods are tested.

3. Do this under the supervision of a qualified naturopathic doctor who will likely need to supplement your diet with the appropriate vitamins and minerals.

4. Stay on your schedule of appropriate foods for at least 6 months or longer to see the results for yourself.

5. Have yourself retested every couple of years, or sooner depending on the recommendations of your naturopath as food sensitivities can change.

I welcome you to send me your experiences to let me know how useful this information was for you.

All the best in your adventure back to health!

Motivate Yourself

Why do you want to motivate yourself? Actually, just answering that question fully can be one of the better ways to get your daily motivation. Below are seven more ways that have been provem to work for others. Chances are, some of them will work for you too.

Seven Ways To Motivate Yourself

1. Explain your plans. Usually, by the time I tell my wife about the newsletter I’m going to write, I’m out of my slump and back at the keyboard. Find someone that listens well, and tell them what you want to do. If it is something that you really want, this will almost always get you motivated.

2. Stimulate desire. Imagine the rewards of your effort clearly. Imagination motivates many to sign up for get-rich-quick plans. Good salesmen can have you living in your imagined dream home in minutes, and you’ll feel motivated to do anything to make it real. Just learn to be your own salesman.

3. Use pain. Neuro-Linguistic Programming (NLP) teaches you to link pain with not acting. If you imagine a scene of your kids sitting in jail for drug use - that might motivate you to have that talk you’ve been avoiding. Linking pleasure and rewards to acting is only half of the formula. Remember to link pain to not acting.

4. Develop a true interest. If you have no interest at all, it might mean you need to do something else, but if it’s just a task you dislike, relate it clearly in your mind to the greater goal. I don’t like to drive, but when I remember those mountains I’m going to, I get motivated to drive.

5. Create energy. Coffee can help for a while, but one way or another, you need to have some energy to have motivate yourself. Exercise, sleep well, and watch out for sugary foods - the “sugar blues” will kill your motivation.

6. Have the proper mental state. It’s rare to be depressed and motivated. Resolve some of your negative feelings, and you’ll have more motivation. Another way is to do your important work when you are in a better mood.

7. Make any small step. Commit to raking up one bag of leaves, and soon you’ll want to finish the yard. Any small step towards your goals creates momentum.

You have seven ways now, but you have to actually use them, so how do you get motivated to do that? You have to figure that one out yourself. Humor, by the way, can be a good motivator. Laughing often breaks up the feeling of being overwhelmed. There’s your eighth way to motivate yourself.

Restructuring to Make Oil Giant More Robust

In recent times the most noticeable public role for Peter Sutherland as chairman of BP PLC was hosting the company’s annual meeting. But after a run of oil spills, dangerous accidents and an energy-trading scandal at BP, the 60-year-old former rugby player has charged head first into the scrum.

Last year, the Irish politician and banker forced Chief Executive John Browne to publicly identify his retirement date. After Lord Browne’s shock decision last month to leave a year and a half earlier than planned, Mr. Sutherland must now buff BP’s image and manage the company’s first executive-suite transition in more than ten years.

Despite oil prices dramatically increasing its shares rose just 4.5 per cent in 2006, compared with a 36 per cent increase by Exxon Mobil Corp. and 15 per cent at Royal Dutch Shell PLC. Yesterday, the company announced 4th quarter net income decreased by 22 per cent, in part this can be seen as indicative of lower natural-gas prices and lower production.

BP, meanwhile, faces U.S. criminal probes on multiple fronts — oil spills and corrosion in Alaska; a a refinery explosion in March 2005 which claimed the lives of 15 in Texas; and its energy-trading practices, with federal officials alleging BP traders surreptitiously influenced propane markets in 2004. BP denies manipulating markets and says it is cooperating with investigators on all three inquiries.

Mr. Sutherland’s higher profile also underscores a trend that goes beyond BP: a transition in the boardroom dynamics at many of Europe’s biggest publicly traded companies. Nonexecutive directors here have in the past been criticized for leaving too much decision-making in the hands of powerful executives. In recent times, many companies are moving to strengthen their boards with strong and independent directors.

Up until Shell were shaken by an accounting scandal in 2004, Shell’s British holding company had as its chairman a professor of geology. After the drama, it got in Jorma Ollila, former chief executive officer of Nokia Corp as chairman. Unilever also appointed an external chairman last month to cap a restructuring at the Anglo-Dutch consumer-goods giant.

Mr. Sutherland’s mission at BP has always been to establish a “robust” and independent board of directors he was quoted as saying in an interview recently. After stints as Ireland’s attorney general and Europe’s competition czar, Peter Sutherland in 1993 was instrumental in taking forward the General Agreement on Tariffs and Trade in Geneva. There, he clinched the Uruguay Round, an important trade agreement that set the basis for today’s World Trade Organization. For a man who has achieved so much it is difficult to forsee where he will find his next challenge.

A 50th anniversary gift commemorates a milestone most married couples wish to reach. What can you possibly give a couple after 50 years of marriage? The most meaningful wedding anniversary gift is one that comes from the heart: to express your love and appreciation towards all that they mean to you, how their staying married through the thick and thin of life has influenced you, to tell about the warm and loving memories you shared with them throughout the years.

The 50th anniversary is commemorated by gold and the flower is violet. A gift certainly doesn’t have to be gold, wrap a gift in gold paper or paper decorated with violets.

50th anniversary gift ideas for the couple
• Keepsake personalized anniversary gifts, such as a photo quilt or pillow
• Monthly or quarterly lo-carb, dietetic or fruit gift baskets
• Restore their wedding photo and place in a gold frame
• Have a painting or caricature made out of their wedding photo
• As they probably don’t cook for themselves as much, gift certificates to restaurants would be appreciated
• A gift of theater or concert subscription tickets. Make them a patron with VIP privileges
• The children can create a 50th anniversary keepsake journal gift. Ask family and friends to write a paragraph or two to share a memory with their parents. Or ask for a photo with the couple that the children don’t have and write a caption about it
• Instead of a guest book, buy a music box and fill it with messages of love written on gold or handmade paper from family and friends
• Are they up for a cruise? Take them on a weekend or week long cruise. They probably will enjoy sharing this vacation with others
